Los Angeles, California—Will Smith is facing a lawsuit filed by a male tour violinist who alleges sexual harassment, wrongful termination, and retaliation. The legal action was initiated on Tuesday by Brian King Joseph, a former contestant on “America’s Got Talent.”
Joseph claims that during his working relationship with Smith, the actor was preparing him for what he describes as “sexual exploitation.” In his suit, he names both Smith and Treyball Studios Management as defendants, alleging that Smith engaged in “predatory behavior” and “groomed” him for further exploitation during the “Based on a True Story: 2025 Tour” this past spring.
The lawsuit outlines that Joseph was hired by Smith in November 2024 to perform in San Diego, with an invitation to join the tour and contribute to an upcoming album. As their professional relationship developed, Joseph alleges that Smith expressed a unique connection between them, implying a deeper bond that he didn’t share with anyone else.
Joseph, who became part of Smith’s tour in March 2025 during its first leg in Las Vegas, describes an unsettling incident involving his hotel accommodations. According to the suit, his bag—containing his hotel key—went missing for several hours and was ultimately returned by management, who he claims were the only ones with access to his room.
Upon returning to his hotel room later that evening, Joseph alleges he found clear signs of unauthorized entry, including items left behind that caused him great concern. Among these was a note suggesting a future return for sexual encounters, which Joseph interpreted as a threat.
Days later, Joseph claims he faced backlash from the management team following the incident, where he was reportedly shamed and subsequently terminated from his position, with implications that he fabricated the situation.
As a result of the termination, Joseph asserts he has experienced post-traumatic stress disorder and financial loss. He is now seeking damages for retaliation, wrongful termination, and sexual harassment, asking for a jury to determine the extent of the damages.
Smith’s legal representative has firmly denied the allegations, calling them false and unfounded. The attorney emphasized that they would take all necessary legal steps to contest the claims and reveal the truth.
This unfolding legal matter reflects the ongoing challenges and scrutiny within the entertainment industry regarding inappropriate conduct and the protection of individuals in vulnerable positions. The outcome of this case could have broader implications as it advances through the legal system.
