Oakland, California – A dispute between two individuals at a gas station in East Oakland turned deadly in March 2022, when gunfire erupted and claimed the life of a bystander. Now, almost two years later, the trial of the alleged shooter is underway. Stavon Moore, 29, is facing charges of murder and attempted murder in connection with the incident.

The confrontation began when 24-year-old Tamia Foster accidentally placed her bag too close to Tyja Braswell’s bag while waiting in line at the gas station cashier booth on International Boulevard. The disagreement quickly escalated, culminating in a violent outbreak. A bullet struck 64-year-old Rodney Davis, an innocent bystander, resulting in his death. Braswell was also severely injured and left paralyzed from multiple gunshot wounds.

Moore, who managed to escape unharmed that night, was later arrested based on surveillance footage from the Royal Gas Station. The footage allegedly identified him as the individual responsible for the shooting. Both Braswell and Foster have also been charged in connection with the incident, but their trials will be held separately to ensure a fair process.

Foster, who pleaded guilty and received a suspended prison sentence, agreed to attend a residential treatment program instead of serving time behind bars. As Moore’s trial commenced, defense attorneys and prosecutors meticulously dissected the events of that fateful night. In addition to shedding light on the homicide, the trial provided a glimpse into the realities of day-to-day life in East Oakland, where a routine visit to a gas station turned into a tragedy.

Deputy District Attorney Cathryn Dalton emphasized Moore’s disregard for the safety of others at the gas station. She argued that he opened fire in a crowded area without considering the potential harm to bystanders. Dalton also alleged that Moore continued shooting even after Davis was hit by a stray bullet. According to her, Moore fled the scene in the same white van he arrived in and disposed of the murder weapon.

On the other hand, Moore’s attorney, Ernie Castillo, presented a section of security footage that purportedly showed Braswell retrieving a gun from her fanny pack. Castillo contended that Moore only fired his weapon after witnessing this act, claiming that his client had initially acted as a peacemaker. Castillo asserted that Moore had taken the firearm from Foster to prevent her from using it, as he believed his life and family were in danger.

The video footage displayed the dramatic sequence of events after gunfire broke out. Braswell was left wounded on the ground, screaming for help, while Moore made a swift escape towards the white van where his family members were waiting. Another individual, allegedly a friend of Braswell’s summoned during the argument with Foster, arrived and fled with Braswell’s gun. However, the police apprehended him and discovered the firearm. Forensic analysis linked some of the shells at the scene to Braswell’s weapon, leading the investigators to attribute the majority of the shots to Moore.

As Braswell laid injured and paralyzed, onlookers reportedly ignored her plea for assistance. Instead, they seized the drugs from her fanny pack before fleeing the scene. The defense argued that these actions were indicative of the rough nature of the neighborhood.
