High Court Denies Bail to Accused in Nymphomaniac Case of 10-Year-Old Girl

Mumbai, India – A man accused of repeatedly raping a girl since she was ten years old was denied bail by the Bombay High Court. The court found the crime to be heinous and shocking, leading to the victim experiencing severe trauma and psychological distress, which manifested in her becoming a “nymphomaniac.”

The High Court, in its ruling, emphasized the gravity of the offense by quoting extensively from the survivor’s diary, highlighting the physical, mental, and emotional toll the ordeal had taken on her. The court deemed the accused’s actions as not only offensive but also abominable, resulting in irreversible harm to the survivor.

The survivor’s parents revealed that the accused and his wife took advantage of the absence of the girl’s father, who was working abroad. It was only in 2021 when the survivor turned 17 that her parents discovered her harrowing experiences documented in a diary hidden in her room. The diary detailed instances of the accused raping her since she was in the 4th grade, with the wife allegedly complicit in the abuse.

Following the discovery of the diary, the survivor’s parents filed a complaint against the accused and his wife. While the wife was granted bail by a special court, the man’s bail plea was rejected. The High Court noted that the wife actively facilitated the illicit acts and was likely equally culpable for the crimes committed.

Additionally, the High Court highlighted the survivor’s attempts to seek help by confiding in her mother about the abuse, only to be met with social stigma and inaction. The court underscored the fact that most sexual abusers are known to the child, emphasizing the need for vigilance and protection within familiar circles.

Ultimately, the High Court concluded that granting bail to the accused would further traumatize the survivor, whose wounds are still raw and deeply embedded in her being. The decision to deny bail serves as a reaffirmation of justice and protection for the survivor, ensuring that the perpetrators are held accountable for their reprehensible actions.
