WASHINGTON, DC – New court decision reveals that special counsel’s office is able to access more than 1,600 communications found on Rep. Scott Perry’s cell phone, including some about his interest in assisting former President Donald Trump’s efforts to overturn the 2020 election. The decision comes after months of legal battles over which of Perry’s cell phone messages could be accessible to investigators, due to the special constitutional protections for the work of members of Congress.
Chief Judge James Boasberg of the DC District Court allowed for several of the Pennsylvania Republican’s messages to be handed over to prosecutors, including ones that capture his attempts “to work with or influence members of the Executive Branch” as Trump sought support for disinformation about election fraud. However, Boasberg is allowing Perry to protect about 400 records relating directly to votes he would take, including certifying the 2020 election result under the Electoral Count Act.
Perry’s team has not responded yet to the new order. They previously delayed the special counsel’s office from accessing any of the messages by appealing the FBI’s court-approved seizure of Perry’s phone. Perry has not been charged with any crime, and it is not clear if he is still being investigated.
The court decision releases the bulk of Perry’s messages to investigators, but communications about proposed legislation and the 2020 congressional certification of the Electoral College votes could be withheld from investigators, according to the court decision. Perry had been in touch with Trump and powerful Trump backers around the 2020 election, including White House chief of staff Mark Meadows, Justice Department official Jeffrey Clark, and others who pushed false claims of election fraud.
Perry’s texts also show he lobbied Trump to give Clark classified information after the election. If any of Perry’s phone records are communications directly with Trump, they haven’t yet been made public. This story may be updated with additional information.
