Trump Seeks Court Order to Halt Fulton County Investigation
Former President Donald Trump is seeking a new court order to effectively stop the Fulton County investigation into his conduct following his loss in the 2020 election. The move comes as potential indictments loom in Georgia. Trump’s lawyers have filed petitions this week to throw out the evidence collected by a special grand jury last year and prevent prosecutors from presenting it to a newly empaneled grand jury with charging powers. They are also seeking to disqualify District Attorney Fani Willis from any related proceedings.
According to Trump’s lawyers, allowing the investigation to proceed would violate his fundamental constitutional rights while he seeks the Republican Party’s nomination for the Presidency of the United States. The separate petitions were filed with the Fulton County Superior Court as well as the Georgia Supreme Court, requesting their intervention in the ongoing grand jury process.
Willis, an elected Democrat, has indicated that final charging decisions could come as soon as next month. Throughout the investigation, she utilized a special purpose grand jury, which heard testimony from numerous witnesses, including Trump advisers, former attorneys, White House aides, and Georgia officials. Trump’s lawyers argue that these special grand juries are unconstitutional.
In their filing, Trump’s legal team stated that a regular Fulton County grand jury could potentially return an indictment soon, but they claim that the process leading up to it was without any authority. They used colorful language, saying, “It is one thing to indict a ham sandwich. To indict the mustard-stained napkin that it once sat on is quite another.”
This is not the first time Trump has tried, unsuccessfully, to shut down the state-level investigation into his actions in Georgia. The investigation focuses on his attempts to overturn the 2020 election results in the state.
