GASSAWAY, WV – In a disturbing case that has shocked the community, a West Virginia couple stands accused of causing the death of their infant daughter by allegedly administering fatal doses of alcohol. The couple, James Joseph Smith and Angel Talbert face serious charges, including first-degree murder, after investigators determined that the child died with a dangerous level of ethanol in her system.
Authorities were alerted on the morning of November 16, 2024, when officers from the Braxton County Sheriff’s Department responded to an urgent call at Braxton County Memorial Hospital. Summoned to investigate the tragic death of an infant, the officers documented the chilling scene, noting the child’s face had a discolored appearance suggestive of having been face down.
Following hospital protocol, officers proceeded to the couple’s household on Tunnel Fork Road in Gassaway, seeking answers. Father James Smith recounted finding his daughter unresponsive, contacting emergency services while his partner, Talbert, sought immediate medical help. An ambulance encountered the couple en route, but tragically, medical efforts were futile as the infant was pronounced dead shortly after arrival at the hospital.
An initial review of the child’s medical history, as provided by Talbert, revealed no previous illnesses or health conditions that could have contributed to the death. However, an investigation into the living conditions at the home exposed dire circumstances.
The household suffered from severe neglect, with investigators observing pervasive cockroach infestations. Fundamental utilities such as running water were absent, with the family relying on a rudimentary system for water collection and usage.
The case took a significant turn when pathologists found an exceptionally high level of ethanol in the child’s liver. This discovery, reported on April 10, 2025, prompted further investigation due to its lethality in such a young victim. When questioned about alcohol exposure, the parents initially showed bewilderment, denying knowledge of how such a substance could be present.
However, a follow-up interrogation on April 16 yielded a troubling confession. Talbert admitted that Smith had been using alcohol to soothe the baby, applying it to her gums when she appeared fussy. This inappropriate use had reportedly become routine during the month leading up to the infant’s death, involving both parents.
Following these revelations, the couple found themselves in police custody, charged with first and second-degree murder, among other severe counts, and are currently held without bail at the Central Regional Jail. The tragic circumstances surrounding this case have left the community grappling for understanding as the legal process unfolds.
