Securities Violator Sentenced to Jail and Community Service for Injunction Breach: Kansas Insurance Commissioner Takes Action

TOPEKA, Kan. – A man who had previously been convicted of violating the Securities Act now faces a jail sentence and community service for violating an injunction related to the case. Kansas Insurance Commissioner Vicki Schmidt announced that Michael Davin, a 67-year-old resident of Olathe, has been sentenced after being found in violation of a court order connected to his earlier securities law infractions.

In response to these violations, Davin has been sentenced to serve 45 days in county jail, as well as complete 60 hours of community service. The court order, which Davin had violated, had prohibited him from engaging in any transactions involving securities. Commissioner Schmidt highlighted that this sentencing was a consequence of Davin’s actions, which included offering and selling securities to four individuals between May 2020 and July 2022, in violation of the injunction.

The injunction in question had been issued by the Johnson Co. District Court in February 2020. It aimed to prevent Davin from participating in any offers or sales of securities. However, as per Commissioner Schmidt’s allegations, Davin disregarded this order and proceeded to engage in the illegal transactions mentioned.

Davin’s sentencing comes after he entered a plea of no contest in court. Additional court documents reveal that Davin had previously pleaded guilty to violating the Securities Act for failing to provide necessary information to an investor. This failure included the omission of his prior felony convictions, which included two theft charges.
