Washington, DC – Special counsel Hampton Dellinger has decided to drop his lawsuit challenging President Donald Trump’s decision to remove him from his position. This move comes after a federal appeals court in Washington temporarily removed Dellinger from his role. The lawsuit was seen as a significant test of Trump’s authority to dismiss officials in the federal government who are meant to operate independently.
Dellinger’s case had the potential to impact the laws surrounding protections for federal civil service employees approved by Congress. However, with Dellinger withdrawing his lawsuit, the chance for the Supreme Court to review the independence of his job from the President’s influence has been eliminated.
The case involving Dellinger was the first of its kind to reach the Supreme Court through emergency proceedings challenging the executive power of President Trump. While the case was in progress, it was making its way back through lower courts.
After the federal Circuit Court in Washington, DC ruled in favor of the Justice Department and Trump’s decision to keep Dellinger out of the special counsel role, Dellinger announced his decision to drop the case. In a statement, Dellinger expressed disappointment in the court’s ruling, stating that it would compromise the independence Congress intended for his position.
Dellinger, who had been appointed to the job a year ago for a five-year term, had been actively working on cases of probationary workers who had been dismissed by the Trump administration. His efforts had led to the reinstatement of nearly 6,000 Agriculture Department workers who were terminated. Dellinger’s focus was on advocating for the rights of whistleblowers and ensuring the OSC functioned as an independent watchdog.
In light of the court’s decision, Dellinger recognized the importance of his work beyond his individual role and expressed his commitment to continue making a difference through other avenues. Despite the setback in his case, Dellinger remains dedicated to upholding the values of transparency and accountability within the federal government.
