Trump’s Request to Invalidate Grand Jury Findings Denied by Georgia Supreme Court

The Supreme Court of Georgia has rejected former President Donald Trump’s plea to nullify the work of Fulton County District Attorney Fani Willis and the findings of a special grand jury. The grand jury was assembled by Willis to investigate allegations of misconduct following the 2020 presidential election. In a five-page order, the court stated that Trump had not presented the extraordinary circumstances necessary for such relief to be granted.

Willis launched the investigation in February 2021, inspired in part by a phone call Trump made to Georgia Secretary of State Brad Raffensperger on January 2, 2021. In the call, Trump urged Raffensperger to “find 11,780 votes,” the exact number Trump needed to win in Georgia. Trump has vocally criticized the investigation and continues to deny any wrongdoing in relation to the phone call.

Trump’s attorneys sought to remove Willis from the probe and invalidate the work of the special grand jury, arguing that Willis lacked the authority to investigate the matter. They also referenced Trump’s potential 2024 presidential bid as part of their argument. However, all the justices of Georgia’s Supreme Court unanimously agreed that Trump had not met the requirements for such an intervention, stating that the circumstances were not rare enough.

The special grand jury, which disbanded in January, did not have the power to issue indictments but could make recommendations regarding potential criminal prosecutions. The final report submitted by the grand jury did not disclose any details about these recommendations, except for suggesting that witnesses who may have lied during their testimony should face indictments.

A new grand jury was recently sworn in by Judge Robert McBurney, and they will ultimately determine the fate of the investigation, including whether to bring charges against Trump. Willis has indicated that potential charges could be filed as soon as this summer.

The denial of Trump’s request by the Georgia Supreme Court emphasizes the court’s view that the circumstances did not justify intervening in Willis’ investigation.
